You’re accessing insurance — not suing the other driver

Many people hesitate to make a claim because they don’t want to take action against another person. In Western Australia, motor vehicle accident claims are made through compulsory insurance, meaning you are accessing a system designed to support injured people — not suing the other driver personally.

A process that’s often simpler than you expect

Many people assume making a claim is complicated or confrontational. In reality, these claims are made against an insurance policy (not the individual driver).

With the right guidance, the process can be straightforward. We assist with lodging your claim, gathering the necessary evidence, and managing communication with insurers so you can focus on your recovery.

Ensuring your compensation reflects the full impact

Not all claims are assessed equally. The outcome often depends on how well the injury, its cause, and its long-term effects are documented.

We take the time to properly understand your situation, obtain the right medical evidence, and ensure your claim reflects the full impact on your health, income and day-to-day life. This helps reduce the risk of delays, disputes or undervaluation.

Support for both short-term and long-term impacts

After an accident, you shouldn’t have to manage the process alone. From the initial claim through to resolution, we provide clear advice and ongoing support so you always know where you stand.

Frequently asked questions about workers’ compensation

Do I need a lawyer to claim workers compensation?

Vehicle accident claim requires a lot of evidence, which lawyers are trained to obtain along with knowing what information needs to be extracted from medical practitioners to better your position and counteract insurer’s evidence.

The ICWA is not a charity for those who have been injured in car accidents. They are an insurance fund who will be obtaining their own evidence to counteract your evidence, to protect their commercial interest to pay out as little as possible.

Our experienced Perth lawyers can negotiate effectively to maximise your payment, whilst avoiding court proceedings along with its related costs.

Get it right, get a lawyer. With no up-front payment and the insurer covering your legal fees, you have everything to gain and nothing to lose by hiring WA Legal.

Am I entitled to compensation after a car accident in Western Australia?

If you’ve been injured in a motor vehicle accident and another party was at fault, you may be entitled to compensation through Western Australia’s motor injury insurance scheme. This can apply whether you were a driver, passenger, cyclist or pedestrian.

Who pays compensation after a car accident in WA?

Compensation is generally paid through compulsory motor injury insurance, which is managed in Western Australia by Insurance Commission of Western Australia. This means claims are made against insurance, not the individual driver.

Anyone with a vehicle registered on WA roads has Compulsory Third Party (CTP) insurance, provided by the Insurance Commission of Western Australia (ICWA).

This insurance is designed to cover the death or injuries caused by any driver of the registered vehicle to cover pain and suffering, past and future economic loss, claims management expenses and treatment, care and support (including medical treatment and rehabilitation).

The ICWA does not cover any costs related the damages of your vehicle or accessories/ items inside.

What can I claim compensation for?

Compensation may cover a range of losses, including medical expenses, rehabilitation costs, lost income, and in some cases the long-term impact of your injuries. Each claim is assessed based on its individual circumstances.

You may be eligible to claim if you were injured in a motor vehicle crash or are financially dependent on the personal fatally inured in a car crash.

You must also be able to prove another driver was negligent with the exception of hit and run citations where the driver was unidentifiable or the vehicle at fault was unregistered.

What if the accident was partly my fault?

You may still be able to claim compensation even if you were partly at fault. The amount of compensation may be adjusted depending on the level of responsibility attributed to each party.

How long do I have to make a claim?

Time limits apply to motor vehicle accident claims in Western Australia, so it’s important to act promptly. Delays can affect your ability to make a claim, so seeking advice early is recommended.

How long does a motor vehicle accident claim take?

The timeframe can vary depending on the complexity of the claim, the severity of the injury, and whether liability is disputed. Some claims resolve relatively quickly, while others may take longer to finalise.

Will I have to go to court?

Most motor vehicle accident claims are resolved through negotiation with the insurer and do not require going to court. Legal proceedings are usually only necessary if a resolution cannot be reached.

What should I do immediately after a car accident?

You should seek medical attention, report the accident, and collect as much information as possible, including photos, witness details and contact information. Proper documentation can help support your claim.

Can I still make a claim if my injuries appeared later?

Yes. Some injuries take time to develop or become noticeable after an accident. It’s important to seek medical advice as soon as symptoms appear and ensure they are properly recorded.

What if the other driver was uninsured or cannot be identified?

You may still be able to make a claim in certain circumstances. These situations can be more complex, so getting advice early can help clarify your options.
